Changes to the Community Safety and Policing Act implemented in April are predicted to lead to a rise in police use of force against community members, especially those from Indigenous and other BIPOC groups. Defence counsel need to be ready to effectively expose, argue and win on these issues.

Join us on November 5, 2024 for a CPD with Jay Herbert, Hilary Dudding and Airianna Murdoch-Fyke to understand this trend, learn about the newest jurisprudence, and to develop a tool kit of strategies - beginning from the time of the arrest and ending with your closing submissions - for fighting back where the police use violence against your clients.

  • Why the changes to the CPSA lead to a rise in incidence of excessive force, particularly against Indigenous people;
  • How the media can be used as an effective tool at the outset of a case
  • How to lay an effective evidentiary foundation for your excessive use of force application: surveillance video, subpoena, booking hall video, medical records, bail court observations, use of force reports and more;
  • McNeil Reports - how they can be circumvented by ‘frequent flyer’ police officers;
  • Bad character evidence and post-Ghorvey jurisprudence;
  •  Recent jurisprudence and framing your argument.
